Dear Mr. Wahl,

Enclosed is a notice of small claim that I have filed against Gateway Express Mortgage, Inc. for one violation of 47 U.S.C. Section 227, which prohibits unsolicited faxes. Please note that the $500 amount I am suing for is statutory.

My original intent was to go after the person Gateway Express Mortgage hired to send the faxes, but Dan Doran refused to tell me who that person was. Because of this, I was forced to sue your company directly.

I am willing to accede to an out-of-court settlement in one of two ways:

1) For the sum of $524.94 ($500 judgement, $21 filing fee, $3.94 service fee); or

2) For the sum of $24.94 ($21 filing fee, $3.94 service fee) and a signed affidavit stating the name and contact information for the company Gateway Express Mortgage hired to send the faxes.
